Geo. W. Booker admr of David Mays Decd vs the heirs of David Mays dec'd.
This cause came on this day to be heard upon the papers formerly read and it
appearing to the court that more than one month has elapsed since the return
of the subpeona awarded against Thomas C. Moore, Phillip Cayton and Mary his
wife and the answer of George D. Gravely guardian ad letum for the infant
defendants John, Robert, and Berry Moore, infant children of Wm B. Moore and
Nancy Moore; the bill is taken as confessed as to the said Thomas C. Moore and
Phillip Cayton & Mary his wife, and it also appearing to the satisfaction
of the court that the order of Publication awarded against the absent
defendants Robert G. Mays, the heirs at law of Thomas Mays dec'd,
whose names are unknown, James Moore and Eliza Moore has been published in the
Danville Register for more than four weeks and was argued by counsel upon
consideration whereof the court doth hereby order adjudge and deem that Geo.
W. Booker who is hereby appointed a comissioner for that purpose shall after
giving at least twenty days notice of the time and place of sale, sell at
Ridgeway, Henry County, VA, the tract of land in the bill in the proceedings
mentioned for 25 dollars cash in hand and
the balance on a credit of six and twelve months taking bond and security from
the purchaser and report his proceedings to court in order to a final decree.
