DEED: Henry Mayes to Timothy Ward; 11 July 1760 - Mecklenburg Co., VA Deed Book 1 pg 488;
This Indenture made this Eleventh day of July in the year of our Lord Christ one Thousand seven Hundred Sixty Between Henry Mayes of the County of Mecklenburg of the one part and Timothy Ward of the County of Brunswick of the other part. Witnesseth that the said Henry Mayes for in Consideration of the sum of Fifty five pounds current money of Virginia at and before the Ensealing here of by the said Timothy Ward in hand well and surely conveyed (?)and paid the receipt wereof the said Henry Mayes doth hereby Acknowledge whereof Every part thereof doth aquint and Discharge the said Timothy Ward his Executors and administrator by these presents have granted and sold and do by have presents grant Bargain and well unto the said Timothy Ward his Heir's and Asigns forever one Certaijn tract & parsall of land Containing Five Hundred and Fifty acres Lying and being in the County of Mecklenburg on the Head of Jenito Creek and Bounded as followeth towit.
Beginning at a black Jack thence South Twenty degrees West one Hundred and Twenty poles to red oak
Thence South Fifty nine Degrees West Forty poles to two black Jacks on a path
Thence South Twenty seven degrees West Eighty poles to a Black Jack
Thence South six degrees East forty poles to a white Oak
Thence South thirty Eight degrees East fifty four poles to a Black Jack
Then North Eighty nine Degrees East one Hundred and four poles to a great Poplar
Thence North Sixty three Degrees East one Hundred and seventy poles to a great red oak
Thence North Twenty nine Degrees East two Hundred and twenty poles to a black Jack
Thence North sixty seven degrees West fifty six poles to a Hickory
Thence North Seventy four degrees West two Hundred and Twenty poles to a white oak
Thence south Forty seven degrees West fifty poles to the Beginning
And to hold the said Five Hundred and fifty acres of land and all and Singular the premisses with the Appertenances unto the said Timothy Ward his heirs and Assigns forever to the only use and behalf of the said Timothy Ward his heirs and Assigns forever provided always and upon Condition never theless that if the said Henry Mayes his Heirs Executors and Administrators or either of them shall well and truly pay or cause to be paid unto the said Timothy Ward his Executors Administrators or Assigns the sum of Fifty pounds Current money of Virginia together with the Interest arising or growing due the same after the rate of five ------ annum from the day of the date hereof with the clerks Charge for recording the Deed untill the thirtyeth day of December in the year of our Lord Christ of 69 that then anf from thence forth it shall and may be lawfull to and for the said Henry Mayes his Heirs or Assigns unto he said Premisses with the Appurtenances wholly to Rentor and the same to have again reposses and enjoy as his or their former estate any thing herein contained to the contrary not withstanding the said Henry Mayes for himself his Heirs Executors Administrators and Assigns doth coveniant and promise to and with the said Timothy Ward his heirs and Assigns by these presents that if default be made in Payment of the sum of Forty five pounds current money together with the Interest thereon due and the Clerks Charge for recording this, herein before the said Proviso mentioned at the day place and time before mentioned and him due for the payment thereof that then the said Timothy Ward his heirs and Assigns shall and from time to time and at all times forever hereafter peaceably and quietly have hold use possess and enjoy all the said Lands and all other the said premisses with the appurtenances herein before mentioned to be granted bargained and sold and every part thereof without the ---- suite trouble ---- Disturbance or Interruption of the said Henry Mayes his heirs Executors and Administrators and of all and every other person or persons whatsoever and Discharged of and from all former and other bargains, sales gifts grants Leases Recognizances & patents Judgements Executions and all charges Estates Tithes Troubles and Incumberances what soever had made Commites suffered or done by the said Henry Mayes or by any other person or persons whatsoever and further that if a default be made in payment of the said sum of money the interest arising due afore other day place and time aforesaid with the Clerks charge for recording this that then the said Henry Mayes his Heirs and all and every other person or persons lawfully having claiming or pretending to have or claim any manner of Estate Right title Interest Claim or Demand whatsoever of in or to the said land and premisses with the Appurtennances or any part thereof shall and will make do suffer and Execute all and every such farther saw full resonable act and acts thing and things for the further better and more perfect assurance shurely sure making and Conveying of the said land and premisses with the appurtances and every part thereof the said Timothy Ward his Heirs and Assigns to his or their Council learned in the law shall reasonablly advise and Require in wittness whereof the said Henry Mays hath hereunto set his hand and Affixed his seal the day and year within written. Memorandom that on the Eleventh day of July in the year of our Lord Christ one Thousand Seven Hundred and sixty seven full and peaceable possession and sizer of the land within mentioned with the Appertenances signed and Delivered by the within named Henry Mayes unto the within named Timothy Ward according to the former Effect of the written Deed.
At a court held for Meclenburg County the fourteenth day of September 1767 This Indenture and memorandum of Livery and Seizsin endorsed was Acknowledged by the within Henry Mayes party thereto and ordered to be recorded. Signed Test John Tabb OMC
