            Personally appeared before me Thos. J. Johnson, Clerk of the County Court of said County, Nancy Trease, wife of the said Joshua M. Trease, the feam? covert, and having by virtue of the authority in me vested, been examined privately and apart from her said husband Joshua M. Trease, and she having acknowledged the due execution of the within deed by her freely, voluntarily, without compulsion, constraint or coercion by her said husband, the same is therefore certified.

            Personally appeared before me Thos. J. Johnson, Clerk of the County Court of said County, Johnson Mays with whom I am personally acquainted and who acknowledged the execution of within deed for the purpose therein contained upon the 2nd of Sept. 1848.

            This Indenture made and concluded this third day of October Anno Domini 1846, by and between Joshua M. Treece, and his wife, Nancy Treece formerly Nancy Mays, and Johnson Mays of Claiborne County in the State of Tennessee, and, William Baker and his wife Rachel Baker, formerly Rachel Mays of Hardin County in the State of Kentucky of the one part, and Joseph B. Morton of Lee County in the State of Virginia of the other part witnesseth, That the said Joshua M. Treece and his wife, Nancy, Johnson Mays, William Baker and his wife Rachel, for and in consideration of the sum of one hundred and fifty dollars to them in hand paid by the said Joseph B. Morton, the receipt whereof is hereby acknowledged, have and by these presents do bargain and sell, alien enfoeff confirm and convey to the said Joseph B. Morton, and to his heirs and assigns forever, all the right, title claim interest and demand whatever that they have of in and to the following described land lying and being in the County of Claiborne in the State of Tennessee on the head waters of big Barren Creek, and which land belonged to the late Thomas Mays, deceased, at his death, and have decended to his children and heirs at law twelve in all of whom the said Nancy, Johnson and Rachel are three, and which lands are bounded as follows to wit: Beginning on two Spanish Oaks the corner between Ashleys old 60 acre tract and 90 acre tract thence north 20 degrees East 40 Poles to two hickories and a black oak on Kely’s line, thence North 31 west 100? poles to a post oak & two black oaks Kely’s corner, thence on Kely’s line North 70 East 30 to a post oak and black oak, Ashley’s old 60 acre corner, thence North 12 West 160 poles to 2 black oaks, thence south 75 west 160 poles to a black oak, being Ashley’s back line, thence North 15 west 15 poles to a black oak, thence south (75*) west 80 poles to 2 chestnuts and hickory, Thomas Brewer’s corner, thence south 25 East 180 poles to a hickory being a conditional line between Hurst and Brewer, thence south 35 west 4 poles to a hickory, thence south 15 east, 18 poles to 2 Spanish Oaks and a post oak, thence south 25 east 170 poles to a hickory and white oak and 2 black oaks - Harmons Corner on Harper’s line - thence North 77 east 68 poles to a hickory, thence north 81 east 58 poles to a black oak and post oak, thence north 8 west 9 poles to a Spanish Oak, thence North 88 East 22 poles to a black oak, thence north 7 west to a Spanish Oak and hickory in the room of two post oaks cut down, thence southwardly on Harmon’s line 30 poles to 2 hickories, thence north 65 East 40 poles to the beginning, to have and to hold to the said Joseph B. Morton and to his heirs forever in fee simple the three twelths undivided parts of said tract of land - And the said Joshua M. Treece and his wife Nancy, Johnson Mays, William Baker and his wife Rachel, do for themselves their heirs executors & administrators do covenant to and with the said Joseph B. Morton and his heirs and assigns that they will warrant and forever defend to him the three undivided twelfth parts of the tract of land hereby conveyed free from the lawful claim of all manner of persons whatever.

            In testimony whereof the said Joshua M. Treece, Nancy Treece, Johnson Mays, William Baker and Rachel Baker, have hereunto set their hands and seals the day and year first above written,
