Mayes, Henry, will presented to court 18 Nov 1713, by John Copedge. (This is a burned will-one of those lost in the fire of 1710, and which was recorded in a will book erroneously entitled Wills 1706-1720. All of the wills in this book were probated prior to the fire.) This particular will has date of probate 18 June 1702. Note is made of it and others in this Order Book because of the new information given. The above named John Coprdge has now entered the picture because he has married the widow of Henry Mayes Sr. A son Henry Jr. and the widow, were the executors. Henry Jr. died a short time before the fire and the widow died shortly after the above entry as on pg 12 of this Order Book we have the following information: 20 Jan 1813/14, Christopher Mayes, only surviving son of Henry Mayes applies for administration of that part of the Estate not yet administered, the executors being dead.

This will of Henry’s was found by Shirley at COUNHOUSS@aol.com in Will Book 1706-1720, pg. 205,206.

 

In the name of God amen, I Henry Mayes being sick and weake in body but of good and perfect memory do give  and bequeath my soule to the almighty God my maker and my body to the earth from whence it came nothing doubting butt to receive again at the Generall Resurrection by the mighty power of God and form my wordly estate wich it pleased almighty God to bestow upon me farr above my desert I do devise and dispose the same in manner and forme following. Item I do give and bequeath unto my dear and well beloved wife Elicia Mayes my dwelling house and plantation with the portion of land belonging thereunto during her naturally life and afterwards the said land together with the plantation shall descend unto my sone Henry Mayes and his heirs forever. Item I do give and bequeath unto my son Mayes that other part of land where my sone Henry now liveth to him and his heirs forever after the death of his Mother. I give and bequeath unto my son Christopher Mayes my land which I have at the head of Scotland Mill Creek being by estimation one hundred and fifity acres of land  to him and his heirs forever. Item I do give and devise unto my sone Christopher two cowes to be by him posessed after my decrease. Item I give and devise unto my daughter Elizabeth one Mulatto Girl named Elizabeth after her Mothers decease and as for the rest of my Estate of Goods and Chattels I leave to be disposed of at my Wifes desire and as for that Parcel of land which I have sold unto Doctor James Innis bounding upon the land of Thomas Mayes my will and pleasure is that my Executors hereafter named shall acknowledge my right together with my wife's right in the county Court of Northumberland when thereunto required and what my said executors shall do in the premises shall be assigned  to all intents and purposes if I were actually present. Lastly I do nominate my now wife Elicia Mayes to be my sole Executor to this my last will and testament revoking all former Wills or Wills Testament or Testaments by me heretofore made or done ratifying and confirming they and none other to be my Last Will and Testament whereof I have hereunto sett my hand and seale this twelth day of April in the year of our Lord 1702.

Dio Juny 18 1702 This Will was proved in Northumberland County Court to be the last Will and Testament of Henry Mayes, deced, the Will being recorded by the Oaths of Edmond Basye and Joseph Palmer witnesses to the said Will and is recorded.

Diom Nov 18 1713  This Orignal Will was presented into Northumberland County Court by Mr. John Coppage and the records wherein the same recorded being burned with the office On the said Coppage's motion the same is again admitted to record and recorded.
